We’ve received clarification from the county that the public hearing to appeal the proposed lot split will take place on Tuesday, September 24th at 3:30 PM. 

This is a critical moment where the Board of Supervisors (BOS) will decide whether to approve or deny the developer's attempt to bypass the California Environmental Quality Act (CEQA) for this project.

Here are a few key concerns you can raise in your letters to the BOS or during any spoken testimony at the hearing.

Remember, this hearing is about the developer's attempt to split the lot and remove wetlands—a tactic with no legal standing.

Key Concerns

1. Piecemealing: The developer is trying to split the lot to avoid environmental regulations, allowing them to skip critical assessments like a traffic study or an environmental impact report. If this lot split is approved, they will leverage AB2011 and SB330 to fast-track the project. These affordable housing laws require that the site contain no wetlands or environmentally sensitive areas, and the developer is trying to parcel off the wetlands to claim the site qualifies. This is a deliberate attempt to bypass environmental safeguards.

2. CEQA Exemption: The California Environmental Quality Act (CEQA) exists to ensure that the entire scope of a project is considered for environmental review, not just individual components. This minor land division should not be exempt from CEQA regulations, which are vital to responsible, sustainable development in our community.

3. Traffic and Safety: Approving this project would at least double or triple the traffic on Foxmore Lane, right at the Green Valley Elementary school drop-off points. The road is already hazardous, and adding more cars to a road that wasn’t designed for this volume of traffic is irresponsible. It begs the question: who does the county represent—its taxpayers and school children, or the developer? If you’re unsure, try driving through the area during school pick-up at around 3 PM.

4. Stormwater and Drainage Risks: The project proposes building over natural stormwater conveyance. Our calculations, in collaboration with a leading stormwater management civil engineer, show that stormwater runoff and volume could increase 3-4x during storms. Downstream neighbors will face serious impacts—these creeks already have high erosion risks. Increased flow will not only erode streambanks, structures, and backyards but also pose safety risks to people, pets, and wildlife. Proper mitigation is essential, but the current plans do not adequately address these concerns.
